Open Question: Can Payday loans (check advances) be used in bankruptcy Ch. 7? Please read for more?
I’ve gotten into the check advance rut. I have to pay the check off & write another one, causing me to pay $60 in fees per month. I went to an attorney for a free consultation for Bankruptcy Ch. 7. In the papwork I filled out, it asked what type of debts I owed. Payday loans was an option (I do owe much more than this, though). I’m trying to come up w/the money to do the bankruptcy (I really have no other choice). I just had to pay the check advance & write another check. When I got home, I read my copy (truthfully, for the first time…most people don’t read the “fine print” & I’m one of them, sadly). In the paper I signed, it says you’re signing to say you aren’t going to be going bankrupt & says something about arbitration. Does this mean the bankrupty would NOT cover the payday loan? Am I going to have to pay this somehow & not be able to file it in the bankruptcy? (I live in TN, if that matters). Thank you!

Open Question: How can I collect from a person who is about to declare bankruptcy?
This person took a $40,000 down payment for a house, refused to transfer the title or tell the bank about the down payment and the bank foreclosed on the house. The person now refuses to return the $40K deposit. Yes, I have an attorney; yes, I am suing the crook and yes I know now that the $ should have been paid into escrow, not given to the “seller”. But I’d appreciate any advice you might have and my attorney is the kind of guy that would not be offended by any suggestions. This case is in the state of Washington.
