Open Question: If I file Chapter 13 bankruptcy, how will this affect the co-signer of my car?
I am meeting with a lawyer Friday to discuss Chapter 13 bankruptcy. In 2006, my Mother co-signed for my car. Even though I didn’t want her to, it was the only way to seal the deal. I’ve already tried to trade in or refinance the car to get her name off of it but the amount I owe and the mileage on it makes that impossible. I would get less than half of what I owe if I traded in. I was also told I’d need a co-signer again which would defeat the purpose. This is my only option. As long as I make the agreed upon payments, should she have to pay anything on the loan? By the way, I live in Texas if that changes anything.
I don’t know any other way to have her name off the car. No dealership wants to work with me since I owe so much. Not even the dealership that ripped me off in the first place.
